1. Since rescission or cancellation of a deed is an equitable remedy, failure of consideration need not be the only basis on which relief may be granted. Other grounds, such as hardship, undue influence of fraud, may be available. 2. The fact that Rule 2 of our Rules of Civil Procedure states that all procedural distinctions between actions, suits and other judicial proceedings at law or in equity and in the forms of action are abolished does not mean the distinction between our various statutes of limitations and the equitable doctrine of laches are also abolished.
